Terms and conditions

I. General provisions

1.1. These Terms and Conditions (hereinafter “T&C”) govern the rights and obligations of the parties arising from the sale of goods through the online store operated at www.le-bohemian.com.

1.2. The Seller is Nikolay Velichkin, Registration No. (IČO): 02438178, VAT ID (DIČ): CZ9401263300, registered address: Ke Kapslovně 5, Prague 3, Czech Republic, registered in the Trade Register (hereinafter “the Seller”).

1.3. The Buyer is any person who purchases goods based on a personal transaction with the Seller (hereinafter “the Buyer”).

1.4. The goods offered are primarily pre-owned (vintage) watches. These are items that have been previously used and may exhibit signs of wear consistent with their age and prior use.

II. Conclusion of the purchase contract

2.1. The presentation of goods on the Seller’s website is informational in nature and does not constitute a binding offer pursuant to Section 1732(2) of the Czech Civil Code. The website serves exclusively for presenting the offer and for contacting the Seller. It is not possible to conclude a distance purchase contract through the website.

2.2. All sales are conducted exclusively in person. The Buyer has the opportunity to personally inspect the watch, verify its condition and authenticity before purchase. The transaction does not constitute a distance contract or a contract concluded outside of business premises.

2.3. The purchase contract is concluded at the moment of personal handover of the goods and payment of the purchase price.

III. Price and payment terms

3.1. Prices displayed on the website are listed in EUR and are final. The Seller applies the margin scheme for second-hand goods pursuant to Section 90 of the Czech VAT Act No. 235/2004 Coll. (VAT is calculated on the Seller’s margin, not on the total price). VAT is not shown separately on invoices.

3.2. The Seller accepts the following payment methods: bank wire transfer and cash payment upon personal collection.

3.3. The purchase price is due before delivery of the goods, unless otherwise agreed.

IV. Handover of goods

4.1. Goods are handed over exclusively in person in Prague by prior arrangement. At the time of handover, the Buyer has the opportunity to thoroughly inspect the goods and verify their condition.

4.2. The risk of damage to the goods passes to the Buyer upon personal collection.

4.3. A handover protocol or purchase agreement identifying the watch (brand, model, serial number, condition) will be prepared at the time of handover.

V. Right of withdrawal

5.1. All sales are conducted in person, allowing the Buyer to thoroughly inspect the goods before purchase. As the transaction does not constitute a distance contract or a contract concluded outside of business premises, the 14-day right of withdrawal without reason pursuant to Section 1829 of the Czech Civil Code does not apply.

5.2. This does not affect the Buyer’s statutory rights arising from defective performance (complaints) under Article VI of these T&C.

VI. Warranty and complaints

6.1. The Seller provides a 6-month warranty on the functionality of the watch movement from the date of delivery to the Buyer.

6.2. The warranty covers defects in the watch movement (mechanical or quartz calibre) that arose without fault of the Buyer.

6.3. The warranty does not cover: cosmetic imperfections consistent with the age of the watch (scratches, patina, dial discolouration), wear of the watch crystal, normal wear of the strap or bracelet, damage caused by unauthorised modifications, drops, contact with water (unless the watch is designed for aquatic use), or timekeeping accuracy of older mechanical calibres beyond standard tolerances.

6.4. To file a complaint, the Buyer shall contact the Seller at sales@le-bohemian.com with a description of the defect. The Seller shall resolve the complaint within 30 days of receipt.

VII. Personal data protection

7.1. Information regarding the processing of personal data is set out in a separate Privacy Policy document available on the Seller’s website.

VIII. Final provisions

8.1. These T&C are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.

8.2. Any disputes shall be resolved primarily through amicable negotiation. The Buyer has the right to contact the Czech Trade Inspection (www.coi.cz) as the authority for out-of-court resolution of consumer disputes.

8.3. The Seller reserves the right to amend these T&C. The updated version will be published on the website. Contracts concluded prior to the amendment shall be governed by the T&C in effect at the time of conclusion.
